Not all commercial leases are considered retail, so it is important to get legal advice early to understand what applies to your situation.

A Heads of Agreement outlines the main terms agreed between the parties before the formal lease is prepared. It may include the lease term, rent, options, outgoings, and fit-out obligations. While it is often described as “non-

If the lease is covered by the Retail Shop Leases Act, then the landlord cannot pass their legal costs on to you. For other types of leases, this may be negotiable and should be discussed up front.
